It is criminal offense to take any bookings without financial guarantee arrangements with the FMC for vessels embarking passengers at a US port that have berthing capacity for 50 passengers or more. A Passenger Vessel Operator must apply for and obtain a FMC-issued Performance Certificate before advertising or booking passengers on a cruise embarking passengers at U.S. ports
