In order to "Trademark" a product... a company has to put that name on a product, "TM" it,and SELL IT... as far as I know. I did work for a Fortune 500 company... I would produce small amounts of packaging for products... just so it could get into a couple of stores and PRODUCE A SALE. That was very important to them... very hush hush. That was 20 years ago. But I'd be surprised if things have changed. Far as I know or understand... a company needs to document some sales under the proposed trademark name before it can become a "registered" trademark. Any company can put the "TM" designation on anything they sell... pending lawsuits from other companies. By putting the "TM" on there it indicates they will seek the "Circle R" designation... the capital R with a circle around it which means "Registered Trademark". Crookedneck likely knows something about this. If some other company has applied for the Registered Trademark in question here... they had to have some documented SALES of the product. This is possible. For NRTI to apply for a registered trademark prior to SALES OF THE PRODUCT would be a shaky proposition. Hey... I'd like to apply for registered trademark status for some, let's say, Halloween Candy called "Day Of The Dead" candy. TM. No chance of getting a registered trademark without a PRODUCT.
