It is also public record that this would Not have become a court case if Jay and his Delaware Attorney would have allowed the Fishers emerald expert to examine the emeralds to see if they came from the Atocha. David Horan wanted Jay to let the Fisher's examine the emeralds. Jay declined. Thus the Court Case.

Jay bragged to more then one investor, that the emeralds came from the Atocha.
