The ruling by Judge Lamberth may have hinged on one very important point, HERA allows FHFA to recover the moneys it put into FnF along with 10% interest. FHFA can extract that money from FnF any way that it wants to including the “Sweep Amendment”.

FHFA can extract the money that is owed, but not more than that. It follows that FnF have not yet paid every last dime that is due. It must be very close though! Once FHFA takes more than it is owed, it has breached the contract and it’s role as conservator. Judge Lamberth has not seen a breach of contract up to this point, hence his ruling. It about the only possibility that makes sense.

Again, I do believe Lamberth wanted OUT and yesterdays stamp on his judgment would go a long way in backing up this theory

My opinion, Lamberth wanted out. He wants to go home an lay down. this case was expanding in front of his tired eyes The motion to supplement the record threw him over the top. He found an excuse ( parted the sea ) and went home. He did leave a door open. that was kinda nice of him
