Judge Ellsworth did nothing of the sort. She just kicked it to the jury to declare the statute of limitations issue and said exactly that. In Nevada judges rarely stop a trial themselves, they prefer to let the jury do it. Even in cases like this where the plaintiffs have apparently committed fraud and misrepresentation of the facts.

If tmm had really had ANY rights to use ANY ISI codec back then you think Fernandez would have had to go to DFMI to try and get a license?
