#12714 RE: onemaninnj #12712

Not sure when the commission findings are final if he can ever get it re-instated or not even if he complies with all their demands, and if he does not satisfy the demands, he is also going to loose his bonding capability on top of all this.

The Commission order became final 8/18 and became effective 20 days later Sept. 6th. That is the day the TNR 91.114 Flag would have been placed on thier P-5. They could be re-instated after they comply with all orders and the P-5 renewal requirement issues. There are currently 3 wells that need plugging or brought into compliance on that list. They also need to pay all fines and re-instatement fees. Once all done the Commission will review and if satisfied return the P-5 to "active" it will likely be delinquent by then... And remove the TNR 91.114 Flag. If they do all that the will also be allowed to keep the bond. To comply with the TRRC order Vince should have already put the wheels into motion. The TRRC will not wait long and will not except any dilly dallying...

On the other hand If Vince does not act in good faith the State will place the wells on the State to plug list and according to threat priority they will be plugged and do the remediation at tax payer expense. PDGO will forfeit the bond and the Texas State Attorney General will file suit to collect the remainder of the plugging and remediation expenses and fines. There could also possibly be criminal charges brought.
