A company putting out a product is fine.

People doing their own research, making their own decisions and using it for their own uses is fine.

A company misleading people with false or unsupported claims about health benefits without independent review is not fine.

Very simplistic and I am sure some isolated exceptions, but basically where I come down on the issue.

I think we both agree on the first 2 points regarding personal freedoms.

Where I think we disagree is on the last point. I don't want so much biased noise in the marketplace by companies with vested interests in profit that it is difficult for people to make their own unbiased, informed choices.

That is, in my opinion, where regulatory authority is helpful and necessary - even if not always perfect. Your example of the legal challenge on folic acid claims is a great example where we need to hold our regulatory bodies accountable. You are right that this reversal of the regulatory decision has been a benefit to society to prevent spinal defects.

But I don't want to throw away our regulatory system. I want to improve it.

Bravo! And a version of "presumed innocent" is exactly what is needed for the nutraceutical and supplement industries. The FDA should be reigned in and made to justify it's decisions.

Why not have an FDA that is required to show harm before the can command the withdrawal of a product? No more of this guilty until you spend a $billion to prove you are innocent.
