Usually in every cases that I took part of negotiation for partnership, sales and license we ALWAYS negotiate an non-disclosure agreement which will cover the negotiation, the product of the company (here the results of the phase I/IIa) and all relative information. It is very broad and usually we add pecuniary sanctions for a breach of this agreement (if not it will be based on a lawsuit).
If ACTC is actually negotiating a partnership they have all the rights to share their results. But obviously they will enter into an NDA way before to give such confidential information to a future partner.
