Yes your correct, but the real government intent is to shutter the industry, with regards to the cement industry without meaningful tax credits for both the remediation developer and the industry it demonstrates to me that there is no support from a regulatory compliance. There is plenty of government intent with coal electricity in Section 45, but the harassment from the IRS makes them just about useless.

Government wants the industries off shore especially the cement industry. It makes no economic sense but unfortunately political sense and economic sense do not always match.
