The fact that the SEC has not caught someone cheating does not mean they are not cheating. If you rob a bank, and the police don't catch you, does that mean you didn't rob a bank ?
Lots of penny stock scams escape getting caught. And the ones that do get caught, are usually flush with gullible investor money. Too little too late.
