I talked to the SEC right after the suspension and they explained what a "no action" letter is. They do NOT issue these letters when an "investigation" is closed / inactive or, for whatever reason, is not pending further action. These letters are issued for an entity seeking permission to offer a service or product which might have uncertainty as to the SEC regulations pertaining to publicly traded companies. The SEC then issues a "no action" letter as a confirmation that no legal action will be taken against the requesting party. It's basically granting permission for a business to carry out its business model and sell shares to the public. Please put this issue to bed !!!! http://www.sec.gov/answers/noaction.htm
