#3711 RE: postyle #3710

It's scary, Postyle...truly scary.

For my fellow retail investors that appear to not understand what we are even waiting for with respect to the Coupons case, here is the deal:

There is one remaining claim in the case -- breach of contract -- which Coupons is trying to get thrown out via a legal mechanism called summary judgment (essentially arguing that even if the facts are interpreted in the light most favorable to DSS, Coupons is entitled to a judgment as a matter of law). This is a fairly high standard for Coupons to overcome, and the law is clear that material factual disputes (as in my opinion appears to be the case here) are not appropriate to be decided on summary judgment.

There are only 2 possibly outcomes of this motion. The judge grants the motion in favor of Coupons and the case is over (subject of course to DSS' right to appeal the decision) or the judge denies the motion and schedules the trial (yes, the trial is the next and final step of this case after the motion is decided -- if the case does not settle before trial as happens a lot in these types of cases).

So this is what we are waiting for. I predict we will have the decision within the month, although could be longer depending on the judge's schedule, etc. (and there is nothing to read into in terms of the length of time it takes him to get his decision out). Let's just all keep our fingers crossed and hope for the best.
