I believe they, the KSWJ lawyers, Research like crazy to be be sure they(kswj) are not infringing upon anyone elses technology....then when they are sure they are unique...they start the application process...then I think they wait while their application is being researched by the Patent Office...if they , the Patent Office, do not find any "infringement"....The Application will be accepted for "review"..of the Technology and then it is "pending"....

I think this is how it goes....this process can take several weeks to months...

Getting the application in can go faster...if the lawyers are good and research well....So the next news could be "patent application 'applied for'"......then the wait for "patent application accepted" ....which I think is equal to "patent pending"

Actual issuing of the patent can take a year to 3 years!

Anyone who wants to correct me ..go ahead..this is just how I think it goes from past experience..

How do I apply for a patent?

Inventors may apply for one of two types of patent applications: (1) A non-provisional application, which begins the examination process and may lead to a patent and (2) A provisional application, which establishes a filing date but does not begin the examination process. How long does it take for a patent application to be processed?

Currently, the average patent application pendency is 24.6 months. Applications received in the U.S. Patent and Trademark Office are numbered in sequential order and the applicant will be informed within eight weeks of the application number and official filing date if filed in paper. If filed electronically, the application number is available within minutes.
