People keep asking the same thing about the 464 patent, to the effect how can there be a patent that is being infringed upon and yet receive no royalties.

Nuts and BB, who ever said the 464 patent was being infringed? Because to my knowledge, no Judge in any court in any jurisdiction has ever said that. And in these matters, the only opinion that counts is the courts.

I am only aware that SmartMetric has 'claimed' the patent is being infringed. If you have information contrary to that, please share.

The best we have been given is a couple of small wins as far as Claim Construction, and a comment by the Judge in the earlier case stating the patent is valid.

Confirming SMME have a valid patent is not confirmation that it is being infringed upon. As I said previous, it could be that no single entity is breaching the patent. They simply may not use all the parts of our 'system', and therefore are not breaching anything.

There are countless patents that are never infringed upon.
