Ben's Appeal argued that Judge Walrath's Opinion should be overturned for lack of jurisdiction and the LTW Holders' claims for 85 % net of the Anchor Litigation Award be remanded to the US Court of Federal Claims.

If Judge Sleet is waiting for Judge Block to assign ownership of the Anchor Litigation Award then I think that would nullify Ben's Appeal to have the LTW Holders' claims remanded to the US Court of Federal Claims - since it would be too late for the LTW Holders to intervene.

What ever Party Judge Block assigns ownership of the Anchor Litigation Award to then that is the Party we need to challenge to recover the 85 % net of the Anchor Litigation Award. In my opinion it would be more difficult challenging the FDIC - if Judge Block deems the Anchor Litigation was never transferred to JPM from the FDIC - than challenging JPM.
