Sure unless they have given up using the property. I would think that under the "not disclosed" terms there was an out.

As part of the settlement, Cdex (OTCBB: CEXI) acknowledged the validity of ASD's patent and has been fully licensed under the patent. Cdex must pay ASD royalties under a fixed payment schedule as well as possible additional royalties for updates to the system.

The agreement also gives ASD audit rights and imposes bookkeeping requirements on Cdex.

The precise terms of the settlement were not disclosed.

"We believe the settlement agreement is fair and equitable to both parties and preserves the right of both companies to continue to develop and practice their respective intellectual property," says Cdex President and CEO Jim Griffin in a statement

Now that CDEX has an "allowance" from the Patent office. The QuESTION is NOW WHAT?? That and five bucks can maybe get one
a CUPPA at starbuckky but w/o a doe-nut.

With no money, no credit, no staff, no manufacturer, no credibility, marketing is out of the question. The "allowance" is worthless.

They could TRY marketing the "allowance" to a company that does have the resources to bring it to fruition... ANYBODY wanta guess what company would be interested??
