Not a credible scenario on HC's part. Although, HC is not exactly pro weed though from my read.

I don't believe that they will never give out licenses but I think that they MIGHT be slow at issuing new licenses until the injunction appeal is heard. So they could literally be slowing the process or not issuing any new licenses for months or a year or more. who knows... That's what I personally believe. But I would love to be wrong. and have some money in this in case I am wrong completely.
