Thunder, I have seen nothing that would lead me to conclude that the Scanbuy court is holding up the introduction of PC. And it would be highly unusual if the court were to do so. The court would have to issue an injunction against NeoMedia ordering it to halt introduction. That would be almost inconceivable given that NeoMedia is the plaintiff and the holder of patents that enjoy a presumption of validity.
Scanbuy would have to use one of its counter-claims as a basis for requesting such an injunction, and it would have to make a convincing showing that it would suffer irreparable harm (harm that cannot be fairly compensated with money) if the injunction is not issued.
