I believe Intellect doesn't hold the patent in Europe...I believe it was JNJ who appealed Intellects patent rights and won back in 2011. Intellect said back in 2012 that they were appealing that decision but there hasn't been any update since then, and I don't know if anyone can help me out with this but I don't believe Intellect has been issued the patent in the US yet either. I never saw them announce it. So Bapi being tested again really doesn't do anything for Intellect at this time.
