ORDER REMANDING FRANK J. KRISTAN TO FEDERAL CUSTODY

Pursuant to this court’s order dated April 9, 2009, hearings convened at the U. S.
Bankruptcy Court in Portland on June 24, 2009, to consider whether Frank J. Kristan, having
failed to satisfy the obligations imposed by this court’s April 9, 2009, order should be remanded
to federal custody.
Jonathan Doolittle, Esq., appeared for Trustee John Turner, and Frank J. Kristan
appeared without counsel.
The uncontroverted record demonstrates that Frank J. Kristan failed to pay the
judgment addressed in the April 9, 2009, order in full under the terms of that order, and that,
notwithstanding several consensual extensions of time, the judgement remains unpaid.
It is, therefore, ORDERED that, pursuant to this court’s civil contempt authority, Frank J.
Kristan shall be remanded to the custody of federal authorities until such time as the judgement
is satisfied in full or until further order of this court.
