The petition was thrown out.
The basis for that decision was the Court's opinion that the NNVC's attorneys failed to present any defamatory statements that would justify a libel case.:
"In the present case, based on the above principles and considering the article as a whole, the court finds that the alleged defamatory statements identified in the petition constitute protected opinion and are not actionable as a matter of law."

Obviously, had a libel case wherein Pump Terminator was properly identified been brought before this judge, she would have seen fit to throw it out based on her opinion that the NNVC allegations are "not actionable".

As far as I know the company has not responded publicly to the court's decision at all, or specifically as to its intent, or lack of intent, to go forward. If it does, it needs a new set of allegations.
