An experienced commercial litigator who has handled dozens of trials and arbitrations, Mike Conway’s practice encompasses a variety of industries and substantive areas. Mike has represented several private equity firms and other clients in post-closing disputes following the purchase and sale of businesses, and has handled a number of lawsuits involving disputes over the ownership and control of large closely held or family-owned businesses. Mike has also litigated cases in a host of other disciplines, including intellectual property, class action defense, antitrust, securities, employment litigation and sports law.

Currently representing banks in mortgage put-back litigation and financial institutions in lawsuits involving the sale of mortgage backed securities.
Representing a private equity firm in fraud and breach of representation and warranty litigation relating to a client’s purchase of a manufacturing business. Case settled on very favorable terms after victory on a dispositive motion.
Successfully defended a bank in litigation alleging fraud and breach of fiduciary duty.
Representing a private equity firm in insurance coverage litigation concerning a policy providing indemnification for breaches of representations and warranties in an acquisition agreement.
Trial victory in derivative litigation filed against the officers and directors of a closely-held business by minority shareholders.
Defending a private equity firm in breach of contract litigation following the sale of a portfolio company.
Representing a consumer products company in litigation involving the alleged breach of a $1.6 billion supply agreement.
Litigation against a private equity firm involving breach of fiduciary duty to a minority shareholder, who had retained ownership in the company following a sale.
Defending several class actions for clients including financial institutions and consumer products corporations. Substantive claims included purported violations of consumer lending and protection statutes and common law theories. Results in these cases have included denials of class certification as well as victories on summary judgment and motions to dismiss.
In addition to his commercial litigation practice, Mike has extensive experience in employment and sports law. He has advised clients and litigated many cases involving non-competition covenants and trade secret issues. Mike also has handled grievance arbitrations, salary arbitrations and licensing and antitrust litigation for the NHL Players’ Association. His sports-related experience includes:
Obtaining one of the highest salary arbitration awards on record for the NHLPA.
Representing WGN in two antitrust trials against the NBA stemming from the NBA’s efforts to block WGN from telecasting Chicago Bulls games.
Winning an arbitration victory in a nationally publicized retaliatory discharge case involving the U.S. Women’s soccer team.
Mike has practiced and participated in trials in state and federal courts across the country. In addition, he has extensive experience in arbitrations before the American Arbitration Association and independent arbitrators, as well as administrative proceedings before the National Labor Relations Board.
