You're missing the point completely. The point they are making is that Treaty was out of shares to sell. The A/S was maxed... When Treaty realized that they changed the "shares sold" to derivatives or contracts to buy shares at a later date, which by the way carry a higher risk and are typically sold at a lower rate than restricted. So now Treaty has no more shares to sell soon after the BK is filed, so thier claim they had to sell shares for less is Bullshit. Besides that, they also make the point that the PPS was going UP not down so the claim that Treaty had to sell shares they didn't even have for less is again Bullshit...
