There is a statute of limitations for the criminal prosecution but because this is a matter of equity, and equity which was misappropriated, there should not be a statute of limitations on the civil remedy to compel return of the equity shares. Furthermore, the people who received the shares owe income tax on the value of the shares (unless the shares are returned) so asking the IRS to investigate would perhaps speed things up.

The reason for non-cooperation by the parties is clear: Shelly Singhal is attempting to assert control and he does not want these people (including his wife) to return the shares. I think it's MAD -- Mutually Assured Destruction -- coming from somebody who is just very confused. New capital would solve all of these problems, but somebody must step up and provide it so these problems can be solved.
