Malc - While I agree SCRC has their work cut out for them and clearly will have quite a heavy burden to satisfy before prevailing, I will not be as quick as you to declare a victor in this litigation. Most seasoned trial attorneys will say they have lost cases they should have won and won trials they should have lost. The most important phase will be for Scrips to present a scintila of evidence to survive a genuine material issue of fact remains on at least one of its alleged claims. The briefs supporting and rebutting IR's imminent motion for summary judgement will be key to fully understanding all of the arguments, the evidence supporting each, and will enable us to make reasonable projections. Until then, all posts on this subject are pure conjecture.
