This is looking better and better. If you've read my past posts, you know I believe Casper gave ATVI a chance and they blew it. I thought their response on the CA motion was garbage and I figured Casper would move it to CA no issues. They appear to have thought the same. Rather than risk opening themselves to a new Judge, they had to dismiss CA to remove the threat of being punted there.... extreme.
Maybe they think Casper was good to them, maybe they think her slow response last time will mean she will again slow the process (I don't think so... no Bulger type case in front of her now and I think she has lost patience with them).
Whatever their reasons, they are all about defense now and it looks to me they are close to settling and trying to manage the numbers downward.
I don't see Susman Godfrey leaving too much money on the table. They will get their cut which means they are in for the max they can get.
Any settlement number below $100 Million would surprise me. I see $120-$170MM. Remember, WDDD can go back and sue for past damages which will form part of any settlement and drive the numbers up.
