This is the pre-trial phase and both parties are going through the [available] motions (pun intended). Now they are in discovery and going through the motions there (again pun intended).

There have been no rulings on the motions to dismiss or summary judgment in the US Court of Federal Claims. There is nothing bending shareholders over except a vivid imagination.
