I don't think so. In reality, the SEC passes on new FINRA rules and regulations, not the other way round.

And FINRA plays no role at all in the filing of registration statements. If KMAG ever persuades a market maker to file a Form 211, it'll be up to FINRA to pass on it or not. But that's the extent of their contribution to this particular process.
