Oh, I wouldn't read too much in the wording being similar. The clerks for the 9th Circuit aren't supposed to use a lot of creativity in official statements from the court, and so it's likely just become boilerplate language for when bail pending appeal is granted.
Besides, why would Mr. Foley lie about it, presumably on the very eve of his incarceration? That would be quite a strange thing to do, seems to me.
