Au contraire! There is a multitude of material false and misleading statements in addition to the insider dumping that can be proven by fact going back several years. Some can be proven as blatant lies. Companies are not allowed to abuse "forward-looking language" if there is no true basis for it.

Just a few of the supposed statements of fact that that come to mind that were later found to be completely false (this is without looking at my documentation):

* Maycom MP 2000 player currently shipping to the Asian market in time for the holiday season - late 2000.

* CeBit 2002 - IBM "showcasing" e.Digital music player that used the MicroDrive. Shareholder Zibel traveled from Belgium to Germany and found that no one at any of the IBM booths knew anything about it. Appears to have been a blatantly false PR issued to avoid a low not seen since 1999.

* Eclipse HD 1213 in "full production" and both showcasing and preselling the device at CES.

* Unveiling with APS and embedded digEplayer at WAEA when in actuality it was Inflight Canada that did so.

There are other blatantly false statements and MANY that were misleading abuses of forward-looking language.

If there were a lawsuit filed, I believe that discovery would yield a treasure trove of actionable items.
