I guess you don't understand how these firms work. Anytime there is a halt, a re-statement of earnings or other irregularities they sue. That is the nature of their business.
It doesn't metter if this case works or not, they have a bunch more brewing.
Maybe you should direct your feelings to the people who caused this, the companies management and Board.
they (or, at least the "name" lawyers) have been around for quite a while and are two of the usual suspects that show up in smaller securities law class actions. and they're likely to be around well after PHOT is dead and buried.
as far as any ehtics issues - they have all the cover they need bases on the SEC suspension to launch investigations, make allegations, etc.
