This all strikes me, even more so than before, that Medac knows they're in a very bad place with trying to get their product to market in the US. They made no legal effort to block Antares from filing their NDA, they didn't a file citizen's petition with the FDA in an attempt to stop the Otrexup NDA review, and then they let Antares be the first to issue a lawsuit against them this year. Simply, they put up NO challenge whatsoever against Antares in getting Otrexup filed, approved, and marketed. If you're in a position of strength, you don't defend your product this way.

I'm believing they know they snookered the USPO with their formulations claims, and the longer that aspect stayed "under cover", the better for them. Once their patent gets placed under expert legal scrutiny, it will be zapped (so I believe). Then, they'll have to face - with no place to hide - the full force of Antares "loaded magazine" of patent "bullets".

So, how long (really) will it be before Medac can compete in the US with their product?
