Yes, it is covered, if they can PROVE they were actually on the way to a 10M run rate.

Stating a 10M run rate without a single order, is fraud.

stating 10M run rate, because you have 10 orders pending and if 100 more orders come you will make 10M, is forward looking.

Future projections have to have some basis. SGLN's "basis" was they wanted to help sell all those floorless notes I rattled about for years.
