Is this the SECOND case

I get confused - too often - sorry my bad

In one case - Sweeny is the judge and she has said NOW and in the OPEN (is that Fairholme or Perry which I think are the key two?)

Is this the other case - and it appears to be judge Lamberth - and it apperas this judge has not ruled on discovery - but if I remember right this is an argument of fact and interpretation of laws and actions - and is not discovery based?
