Anyone can file a motion...the grounds to file do not have to be reviewed. The hearing scheduled on the 18th allows the judge to review the specifics of the motion.
I bet that no one will show up on the 18th either.
There was no motion for discovery properly filed. And no, the judge did not award a summary judgement because no one showed up. Summary judgements are awarded when the merits / evidence of the case overwhelmingly support no contest to the complaint.
