Defendant's Have Not Raised Any Genuine Issues

Summary Judgment on some or all of the issues should be granted in GERS' favor, in the near future, especially now that the patent office has confirmed GERS' latest patent is valid.

Instead, defendants have resorted to attacking the favorable rulings the good judge has handed to GERS.

Now the USPTO has come over the top and re-issued a re-examined patent as completely and perfectly valid, despite all invalidity contentions from the defendants.

There's absolutely nothing unfolding in the court room that's positive for patent infringing PEIX. This company is being sued by GERS and clearly losing. The defendant's, including PEIX, have resorted to attacking the judge's ruling on the interpretation of GERS' patents claims.

Is there anything in the court case that would give an investor in patent infringing PEIX, such as yourself, hope of overcoming GERS' family of patents?

Today's issuance of yet another patent is clearly a sign the USPTO and the court's are siding with GERS.
