That's not exactly right. The way it works in the Ninth Circus is that until the appellate court rules on the request for bail, he gets an automatic stay. So Foley filed a motion for bail pending appeal and until the US attorney files an opposition brief and the judge rules on that (usually a few days to a week, unless the judge allows a reply brief responding to the opposition brief).
So it's a little more complex. Foley bought himself probably two weeks or so, by filing just before the deadline and using the automatic stay provision.
A couple more weeks to dump his 45,000,000 shares coming off restriction.
