The Honorable Judge Kern of the NY Civil Supreme Court will not be interested in looking back at the posts, whether real or imaginary.

Nanoviricides attorney, Mr. Strain, told the court the following in his affadavit:
11. As to whether the statements posted on the Blog are factual is a question of law for the Court. Nevertheless, Peter Campitiello, a partner in our firm, has listed numerous libelous factual errors in his demand for removal and verification of the defamatory article which was ignored by Seeking Alpha.

PC's demand letter is Document #3 in the proceeding identified below. I don't expect you to look at it...even though it's free and readily accessible....but I think that you would be hard pressed to see where he "listed numerous libelous factual errors" if you did. And, as I said, the judge isn't going to go around turning over rocks in search of the facts that the plaintiff is obligated to present.

Mr. Strain is doing the same thing that I'm seeing here, which is telling the bus driver that the guy behind him is paying. All I asked for is ONE example that "the company (can) demonstrate that at least some of those statements are definitively inaccurate"...as we were told they could and that you tell me that has already been done. Surely SOMEONE can do that without passing the buck.
