Problem is that they are getting involved on the court side because they are not performing the role of conservator - but rather as potential liquidator for the government.

Regardless of what any legal agreement says, if there is an UN-just agency controlling another (government or otherwise) the court must be involved to determine if such a complaint is valid and perform due process.

Otherwise it would be like parents being unable to sue / jail a day care center that severely abused their child - all because the parents signed a disclaimer that the day care is not responsible for injuries...
