02/23/2006 129 ORDER that the transcript and the exhibits in the spoliation and unclean hands hearing held in Hynix Semiconductor, Inc. v. Rambus, Inc. shall be made a part of the record on the exceptional case issue in this action. It is further ORDERED that Samsung Electronics Co., Ltd. shall have the responsibility for securing copies of the transcript and exhibits and filing them in the record in this action and shall bear the initial expense of so doing; provided, however, that the cost of so doing may be sought as a reasonable cost if Samsung is determined to be a prevailing party in this action. The transcript and exhibits shall be filed herein at the earliest possible date, but no later than March 15, 2006. It is further ORDERED that, when exhibits are filed, Samsung shall file an index to the exhibits that cross-reference the exhibit numbers in Hynix Semiconductor, Inc. v. Rambus, Inc., to the exhibits in Rambus Inc. v. Infineon Technologies AG, et al., Civil Action No. 3:00cv524 where the same exhibits appears in both records.
