Keith, I don't think the Judge would be upset, rather this is a smart maneuver IMO that World's is bringing fact to bear. First, the MSJ has only to do with the certificates setting the correct date. It has nothing to do with patent infringement other than when the settlement date starts to accrue penalties. Also, Worlds is showing harm to them which should beg relief. No, I think the Judge will take it in stride. JMHO
