Thoughts on reason for Google to withdraw motion to consolidate appeals: I listened to the conference call again and my understanding is that the first appeal to be heard in the April/May 2014 timeframe is to do with the laches and decimal error on the first $30.5 million award. The second appeal is to do with validity of patents/royalty rate, etc. to be heard in Aug/Sept 2014 timeframe. If the parities are to settle the big issue that needs to be resolved is the laches (375M) and decimal error ($300M). If Google loses on this first appeal they will settle but Google did not also want to lose on the second appeal re ongoing royalties rate. Makes sense to me - thoughts??
