The chart shows the sell-off was over-done IMO, and the facts speak loudly about the value. Vringo has proven infringement of both the old and new AdWords systems. It is undisputed that new AdWords continues to use a candidate advertisement's LTV score that includes a predicted click-through rate in the process of choosing which advertisement will ultimately be shown to the individual performing the query.

The judge said: "Defendants' misconduct continues presently and Defendants have taken no remedial action. "In fact, they have redesigned a system that clearly replicates the infringing elements of old AdWords" and "... it is undisputed that new AdWords continues to use a candidate advertisement's LTV score that includes a predicted click-through rate in the process of choosing which advertisement will ultimately be shown to the individual performing the query."

Microsoft settled. Google will realize the meter is running and interest rates are going to become very expensive in the final solution if they do not press for a settlement. There is a clear point where appeals become obvious delay tactics to the extent they become an injustice. One of the most powerful concepts in our system is that "Equity will not suffer an injustice."

While it isn't known exactly how much Google will be on the hook for, it is believed that Vringo will get more than $1 billion from it. They could probably settle for something in the range of 3/4 of that if they act quickly. Once the basis for their appeal becomes clear, if it is very iffy then the more they delay the more certain that the final costs will soar past the $ 1 billion and include substantial costs for laches.

Despite the insider sales and the successful money made with shorting efforts to date, the market will now quickly recognize the increase in value achieved here.

It all adds up to a quick recovery and my estimates is it will settle for awhile in the $5.75 range while matters are sorted out further.
