Reminder, this is the same defendant who had no problem not only committing to the Markman process; also took a leading role in the cadre of defendant attorneys. That though can still be a good thing if Walgreens truly is interested in settling, as a dominant defendant, one could rationalize that other defendants would be influenced to follow. Just speculation though.
