New Jersey Legislature Passes Hemp Bill

TRENTON, NJ — Both chambers of the New Jersey legislature voted Monday to enact a bill establishing industrial hemp cultivation licenses in the state.

The bill, Senate Bill 3110, was approved unanimously in the Senate on Monday by a 37-0 vote, followed in the Assembly by a vote of 65-8. The bill now heads to the desk of Governor Chris Christie for final approval.

Under the bill, the Secretary of Agriculture can begin issuing licences for the legal cultivation of industrial hemp, but not until the United States government takes action to exclude industrial hemp from the definition of marijuana under the Controlled Substances Act, unless the Drug Enforcement Administration grants New Jersey a permit allowing hemp cultivation in the state.

MONTGOMERY, AL — A bill that would decriminalize the possession of up to one ounce of marijuana, making it a fine only offense, has been introduced in Alabama.

Under the proposal, the offense would not appear on a person’s criminal record. The amount of the fine has not yet been defined in the bill.

MONTPELIER, VT — A anticipated bill to improve Vermont’s medical marijuana program has been formally introduced to the state Senate.

Senator Jeanette K. White (D-Windham) filed Senate Bill 247 this week, which would, among other things, eliminate an existing 1,000 patient limit on patients registered with the state’s medical marijuana dispensaries and add post-traumatic stress disorder (PTSD) to the list of qualifying conditions for medical marijuana in the state.

The bill also increases the amount of marijuana dispensaries are allowed to grow and possess. Currently, dispensaries are limited to 28 mature plants, 98 immature plants, and up to 28 ounces of marijuana. The proposed bill would increase these limits for any dispensary serving more than 14 registered patients to allow for up to 4 plants, 14 immature plants, and six ounces of marijuana per patient registered with the dispensary.

BOSTON, MA — The Massachusetts Department of Public Health (DPH) collected applications Thursday from over 100 prospective registered medical marijuana dispensary operators, marking the Phase I application deadline.

With the passing of Thursday’s deadline, the Department of Public Health is continuing to stay on track for timely implementation the 2012 voter-approved medical marijuana program, as it moves one step close to registering dispensary operators.

“The department continues to demonstrate a commitment to patient needs by moving forward quickly and thoughtfully with the process,” said Matthew J. Allen, Executive Director of the Massachusetts Patient Advocacy Alliance.

“At this rate, dispensaries should be registered to operate by January 2014, if not before,” Allen continued, “Today patients are one step closer to safely accessing their medicine.”
