Most likely the terms of the settlement are not as simplistic as you believe. Not Everyone must get cash up front.

As far as distribution to disinterested shareholders goes, ultimately the amount of money they will see will be miniscule. Few prior shareholders during the period in question will actually see anything to get excited about.
