No this is not a scam but this company cannot balance the books. Paying out more than what is coming in. And to rely on an international lawsuit for income is a joke for a company to do. International law suites rake time....get appealed. Also the Chinese government is very protective over its companies right now. Not to mention how they don't have good feelings toward the US right now.
