It is about legal firepower. Brains against brains. It is my understanding that consolidation is only for pre-trial (markmen), its still in the wilderness one might say
and that companies will have their separate trials..Of course they firepower, 20 legal brains against 3 or 4 have plenty more time to prepare...thus firepower
All can file motions separately, and may possible see some motion on venue and jurisdiction..
This is not about "right or wrong"....USPTO would give a patent on how to swing on a swing....LOL
