The Court didn't ask Carter for an affidavit.
He's asking the court for permission to introduce it as evidence.
He's free to put in as much, or as little, information as he wants.
He's also free to update the information provided, if circumstances have changed.

His affidavit says REVO did a deal in September to sell all of the EyeTalk patents for $500k. It also says shareholder approval for that deal is a foregone conclusion.

He's not filed an amendment to say anything changed in December.
