It was the height of stupidity for the company
to file 5 simultaneous, nearly identical suits against well capitalized national/international companies.
It removed incentive for anyone to settle. It allows for each defendant to collaborate officially or unofficially with each other in their defense.
One loss, and considering they are all nearly identical, will cause the dominoes to tumble. The Walgreens suit is nearly 1 year old and it's not even reached the discovery phase. The other suit haven't yet begun to cost MMRF yet. Wait till they do.
The dilution and the vanity appearances have done nothing for the stock. MoneyTV and other paid promotions get more traction in selling stock. But at the cost of legitimacy. It show's the company hand as a skanky penny stock. Those MoneyTV shows stay with you longer than twinkies.
Legitimate companies use dilution to grow the business. Here, there isn't a business. Are they developing product? Are they selling product? Walgreens knows they are first up for MMRF. They are in no hurry to settle. Trial is scheduled for the END of next year. Trials never come close to being "on time". Walgreens has no incentive to settle. MMRF has every incentive to settle for $1. It will sell stock. But then they'll have to face Quest. And then Allscripts. And then WebMD.
MMRF is desperate for a settlement. Any settlement. But EVERYONE knows it. MMRF has a weak hand.
Problem is, Walgreens, settling sets them up for every sleazy patent troll under the sun to then see them as EASY. Better to take it to trial and lose a few million than to settle for $1 and have to deal with an army of patent trolls.
MMRF painted themselves into a corner.
Also, looking at the objection to Walgreens amended claims.... Walgreens missed by 2 days, a preliminary procedural deadline. One that MMRF admits whose intent is to get the parties to "crystalize" their arguments early in the process so as not to shift arguments late in the game, sandbagging the other side. Two days is not sandbagging late in the game and professional courtesy always allows for such slippage early in the game. And it is VERY early in the game. If Walgreens did this a week before trial--slam dunk for mMRF. Missing by 2 days a year before trial--no wonder MMRF was on a plane out to Ohare.

#2). You want easy money. So does everybody else. They'll get it, too....yours! (and all of it!)
#3). You tell yourself you're smart. You won't lose your money. Fact: Other people are smarter,
